The former Group Managing Director of Nigerian National Petroleum Corporation, NNPC, Andrew Yakubu has sued the Economic Financial Crimes Commission, EFCC, for damages and wants the Federal High Court in Abuja to grant N1bn in his favour against the EFCC as compensation for violation of his right.
Mr Yakubu, claims that his continued detention by the EFCC without charging him to court nor allowing him to complete his medical procedure in the United Kingdom, was a violation of his right, and prayed the court to declare it so.
The former NNPC boss also prayed the court for an order enforcing his personal liberty, dignity of human person, freedom of movement, private and family life. He asked for his immediate release from EFCC custody or that he should be given bail on liberal terms and be allowed to complete his medical treatment in the UK.
He also asked the court to compel the EFCC to tender a public apology to him in two widely read national newspapers for the violation of his right.
The EFCC, however in its opposition to the application through a counter -affidavit has said that the investigation to the allegation was still going on and that there are revelations through findings, that the monies found in custody of Mr Yakubu in his house were not gifts but were suspected to be proceeds of crimes.
The EFCC also said that at the time Mr Yakubu claimed to receive the "gifts" he was a public officer and there were existing laws that barred public officers from accepting those kind of gifts under any guise.
The agency pleaded with the court not to order the release of Yakubu in the interest of justice.
